Suppose that a male driver purchases an auto insurance policy. When he receives his contract, he notices that he's been rated as a female driver instead of male (suppose sex is an allowable rating variable). Also note that the insurer never asked the insured about his sex...

What would happen if insured has an accident ?

Would insurer deny the claim based on utmost good faith principle which says that "Customer must disclose all matters regarding a risk EVEN if not asked by the insurer" ?

Would the answer to the question above be any different if insured does NOT notice he's been rated as a female driver ?

Not a realistic scenario but regardless ... I would answer without reference to the principle of utmost good faith. An insured's gender is information in the public domain. Coverage would not be denied.

Agreed, assuming they have the insured's driver's license number (In Quebec at least) they can get the Gender from that.
