The 7th circuit recently issued an order reinstating a previously dismissed discrimination lawsuit (Groesch vs. City of Springfield), the reinstatement allowed based on the Lily Ledbetter Fair Pay Act of 2009, which extended the statute of limitation for certain discrimination suits and which applies retroactively to cases still pending as of 2007.

In the lawsuit, three white police officers who resigned and then rejoined the police force are suing for back wages because they, but not a black colleague who did likewise, had to start at an entry-level salary when they were rehired.

The interesting opinion illustrates the problems judges will have in determining just what formerly time-barred claims can now be revived.

I don't really see why it's a problem. They would seem to have a legitimate case.
