Accidental Death Benefits treated as Health Insurance under Obamacare?

I did some googling but did not see this clearly addressed. I don't think it's the case, but for you Obamacare experts who have read or understand the bill...

Many states apply health insurance MLRs to accidental death benefit policies (even fully guaranteed, non-can).

Would ADB policies be subject to the MLRs in Obamacare?
