This topic comes up periodically here and there's often a shortage of actual hard information. This article gives some. (I think the link might expire in a few days, so here's the whole thing.)

I am glad I don't live in a neighborhood governed by a HOA. (I'm using HOA to generically represent a HOA, neighborhood association, condo board, board of CC+Rs, etc). The generic aesthetic rules would drive me crazy.

I have no problem with developers doing as they see fit, if there is a market for non-HOA homes then they will be available. I would be if I bought a home in a HOA area and the members increased the restrictions after I bought. (The person drafting an HOA should make it VERY VERY difficult to add additional rules)------ I am shocked by the bolded part but that is our society today, it's all about the community not the individual. Sucks but it keeps moving more towards that. |

I want to read some more anecdotes people have of negative interactions with their HOAs.

I am in favor of HOAs that require people to maintain their houses and keep their yards cleaned up. I am less thrilled about quirky requiremnts about colors and fence regualtions.

Yep. It's interesting, but it's short on data and long on anecdotes. Just that one bolded sentence, and the data part is done.
Personally, I prefer HOA, CCRs, etc. to have jurisdiction over common areas ONLY. The municipality should be able to enforce anything related to health and safety. Beyond that, I'd rather have freedom of choice and the possibility of getting stuck with a neighbor with bad taste or chronic laziness than a guarantee of an aesthetically pleasing neighborhood. (And yes, my nearest neighbor is an alcoholic who has let his place run down horribly, and I don't like looking at it. But unless it becomes unsafe, I say leave the poor schnook alone.) |

I think the first one should be protected by the 1st amendment. I think if the second one bothers you enough that you make a big stink about it, you should make sure you take hyptertension medication everyday.

For anyone that is supportive of using an HOA to enforce maintenance standards, how would you expect the HOA to handle the situation where an elderly person has a porch roof or some soffit that is falling, or trim falling off their house, but they say they don't have the money to have it fixed?
[Assume this maintenance issue is something that is larger than a typical helpful neighbor would repair as a favor or that it is something that a helpful neighbor could fix once, but it keeps recurring or spreading.]
