Default is this flambouyant?

So I posted this in the "jackass at the exam" thread but it didnt even draw a comment...makes me wonder if I am like the "jackass". Would you be upset about this?

3) during read through, same guy had pencil in hand and was sort of using it as a pointer to read. Would be really easy to underline too.

Overall it was just annoying that he seemed to be so flamboyantly breaking rules. I am the person who pushes the pencil completely away during readthrough and after pencils down. And how is the clock beeping not similar to phone or pager going off, which supposedly disqualifies.
