To try to salvage something political from this thread. Should insurance companies be allowed to sell insurance that protects property but specifically does not protect them from the biggest threat they face?

I say if you own a home in a flood plain the only home owners insurance that you can get says "THIS IS NOT FLOOD INSURANCE!" on every page of the policy and the premium bill if flood damage is excluded.

I wouldn't be surprised to hear that some of the agents assumed the policies covered anything catastrophic resulting from a hurricane, icluding the levy breach. The decision announced here is the overturning of a decision by a judge who thought the wording in the policies was ambiguous.

Well, if they didn't buy the flood insurance that is provided by the federal government (under guidelines that technically allow insurers to provide flood insurance, but create sufficient obstacles to make it practically impossible) despite owning homes below sea level in a coastal city, yes, they're pretty stupid.
