Default Mom sues Little League over son's injury

http://www.silive.com/northshore/ind...tles_suit.html

Quote:
A bad slide that injured a young Staten Island player five years ago will cost Little League Baseball Incorporated and the New Springville Little League $125,000.

Jean Gonzalez of Meiers Corners has agreed to settle a lawsuit in which she alleged her son Martin Gonzalez, then 12, tore up his right knee in a New Springville Little League game because he wasn't taught how to properly slide.

Martin injured a ligament and meniscus while sliding into second base on May 4, 2004, court papers said. He was trying to stretch a hit into a double on the coach's instruction.

Now, 17, he underwent two surgeries to repair the damage.

Ms. Gonzalez sued the New Springville Little League, Little League Baseball Incorporated and two of Martin's coaches in state Supreme Court, St. George.

In addition to negligent coaching, she contended a stationary base was used, despite data showing that detachable bases were safer.
Do parents have to sign waiver forms for their kids to play? If not, they will now.

I think the lawsuit is ridiculous. I heard on the radio this morning that she sued the first base coach, claiming that her son shouldn't have been told to go to second on the play.

I don't understand how they settled this. It probably would have been laughed out of court.

Hmm, everything I ever played (that I can remember), my parents had to sign a waiver form. Hard to believe that this league didn't require it.

But @ suing the coach.

Actually, @ the whole thing.

I'm sure they signed a waiver. How can the prove he tore everything on that slide when he was 12. He could have crashed his bike and caused a slight tear, and then the slide made it a full tear. I think I may have to go sue my coaches for not making me a major league baseball player and call it negligent coaching.

It's cases like that that make me distrust the legal system. Seriously, the judge that gave this legitimacy should be fired.

I'm guessing a judge didn't. They settled.

Judge probably didn't give them a motion to dismiss though, and that's what led to the settlement. If they settled before that motion was decided, then they were just dumb.

American society has no other method to resolve differences other than the courts.

It's kinda like that chick that is suing her college for not getting her a job. Absolutely ridiculous. How does the mom know that the coach was teaching right and her son just wasn't paying attention that day?

beginning of the end.....kids will be locked in doors and never allowed to participate in anything. Overprotections by stupid parents and greedy lawyers are contributing to a society where kids just sit indoors all day and play with their Xbox. It makes me sick and angry.

Until XBOX gets sued for harming their eyesight and/or giving them carpal tunnel. It's all a slow march to us ending up like the people in Wall-E.
