Police shutting it down indicates illegal to me. I personally think it is immoral but I do not think it should be illegal if they are consenting adults. People have brought up the speed limit but the nature of those types of laws are to be protective of others (lessening accidents). What I really do not understand is seat belt laws. If the majority of the public does not believe in religion then seat belt laws are counter productive. Wouldn't you want the idiots to die in an accident? The seat belt itself does not protect anyone else...

Supposedly seat belt laws decrease the auto insurance premiums for everyone in the state, as average medical costs go down. Not having working in personal auto, I don't know whether that's true.
