Default Hate Crimes

Prompted by Tupac's thread.

I've always been disturbed by the notion of "hate crimes". Is it just me? If someone kills a person or Race X, or sexualty Y, because they hate that group, does that make that murder any worse than killing for other reasons?

It makes me uncomfortable.

I have wavered on this. I generally agree with the posts so far, but if you target a person because they are a member of a particular group, then that is actually in some ways a threat against the rest of the group. And, that is actually harming more people than a single crime. So, for example, if I kill a guy because I hate him, then that crime damaged one person. If I kill a black man who moved to town and put a sign on his body that says "n*****s go home" then I have effectively threatened all the black residents in town, which damages many people.

It's not a great analogy, AND, even if you accept this in concept, it's not the way the actual "hate crime" laws work, but I can see the point that some people believe these laws have some benefits.

There's no question that hate crime laws were passed as simple pandering to "disadvantaged" groups (quotes to imply that they may or may not have ACTUALLY been disadvantaged).

Why would it make you uncomfortable? Hate crime covers other crimes as well. As a minority (of whatever type), it would afford you further protection from certain crimes e.g cross burnings on your lawn, graffiti on your house or place of worship etc, etc .

Assault and murder are already serious crimes that do need to be placed under the definition of hate crime to be taken seriously, but the others do.

and I'll see your $0.02. I agree with extra punishment for those more likely to commit crime again -- shades of "minority report."

Of course, there is a small problem: How do you determine who is likely to (in this case) murder again?
