The idea of a state as an entity is not a difficult concept. Senate representation is not based on size of the population. You can't use the size of the population of a state to determine the amount of influence a senator should have because the size of the population is not the measure used to determine Senate representation in Washington.

What's your point?

Democrats want the court stacked 9-0 in their favor, and like the Republicans, don't represent the majority opinion of the populace (Since about 1/3 of the populace is Democrat, 1/3 is Republican, 1/3 is moderate/independent).

Agreed. I'm not thrilled with Alito, and would be happy to see his appointment successfully filibustered. But I'd rather have a principled conservative than a crony.
