In it, she says that she's withdrawing over the issue of document requests from Congress and executive independence. OK.

He can't nominate another woman. The big cover over the Miers nomination was that all the other qualified conservative female potential nominees asked not to be nominated because of the venomous nomination process. If they nominate one after the Miers debacle, they'll lose credibility (amongst those who still hold them credible).

Somebody (I'm thinking Krauthammer) mentioned this scenario EXACTLY as how Bush can get out of it:
-Senate requests information
-Bush refuses to supply it based on "executive privelge"
-Senate says they can't nominate her without information
-Nominee withdraws because of separation of powers has nothing at all to do with incompetence, not no how no way.

I have thought from day one that the Miers nomination was put out there only for the purpose of satisfying the critics calling for a female nominee, that she would be so unqualified that when he went with a qualified white male, no one would have the guts to complain.

This is Roves last big play in politics.
